1. (C) Summary: Japanese officials seek continuing close
coordination with the USG to engage China at the highest
levels to express concerns over China's proposed new
information security and content filtering regimes. Senior
Japanese officials have raised the information security
testing regime in recent bilateral meetings with their
Chinese counterparts, GOJ officials told visiting Deputy
Assistant U.S. Trade Representative (DAUSTR) for China
Timothy Wineland in a June 29 meeting. Both sides
acknowledged the effectiveness of ongoing USG-GOJ
coordination and the benefits of both governments and
industry maintaining a uniform approach on these issues.
Wineland provided the U.S. assessment of the current state of
play on China's CCC scheme for information security testing
as well as USG plans to combat China's internet content
filtering regime. End summary.


2. (U) DAUSTR Wineland met June 29 with Ministry of Economy,
Trade and Industry (METI) officials, led by Dr. Ikuo Misumi,
Director of IT Security Policy, to discuss developments and
activities related to China's proposed China Compulsory
Certification (CCC) information security regime and the new
content filtering system "Green Dam." (Note: Subsequent to
these meetings China announced an indefinite postponement of
"Green Dam" implementation, which had been scheduled for July
1.) DAUSTR Wineland and METI officials also held a joint
discussion with representatives of the U.S. Information
Technology Industry Council (ITI) and members of the Japan
Electronics and Information Technology Industry Association
(JEITA).


3. (C) Director Misumi argued for a strong position with
respect to these Chinese policies, asserting now is the time
to "politicize" the CCC issue. He noted PM Aso raised
Japan's concerns directly with the Chinese Premier when they
met in late April. METI Minister Nikai again pressed Chinese
Commerce Minister Chen Deming on the CCC issue June 7 in
Tokyo. The GOJ would like China to completely scrap its CCC
information security proposal and instead join the Common
Criteria Regulation Agreement (CCRA),which offers
internationally accepted standards on IT security. Director
Misumi explained Japan is coordinating with China and other
CCRA members to encourage more constructive dialogue and is
working in China to raise awareness of the CCRA standards and
their benefits.


4. (C) DAUSTR Wineland indicated that the USG, as shown in
the April 29 USQstatement after China announced the
narrowing of the CCC regulations and a further one year
delay, remains concerned about the scope of the CCC for
information security and troubling practices like in-country
testing requirements, as well as questions about the CCC
scheme's applicability to state-owned enterprises within
China. DAUSTR Wineland noted that the USG is in a
preliminary stage of developing USG requests for the 2009
Joint Commission on Commerce and Trade (JCCT) agenda, and the
USG anticipates working on the CCC issue in the JCCT context.
Director Misumi urged a strong and closely aligned
U.S.-Japan position on this matter. (Note: In other meetings
during the week of June 29 in Washington, METI's Senior
Director for Policy Coordination Katsuhiko Kaji delivered
similar arguments to other USG agencies, seeking to improve
Washington agencies' understanding of GOJ views.)


5. (C) DAUSTR Wineland also described USG efforts to combat
China's "Green Dam" internet filtering software mandate,
noted that Japanese associations had participated in an
industry letter to Chinese leadership on this issue, and
inquired about Japan's views on "Green Dam." Director Misumi
indicated Japan was weighing in with China to express its
concerns about "Green Dam."

6. (C) Industry participants provided updates from their
perspective on both the CCC issue and "Green Dam," in a
separate discussion with DAUSTR Wineland and Director Misumi.
Japanese industry is conducting an impact analysis of the
CCC scheme, should it proceed as presently announced.
