1. This is an Action Request. See paragraphs 2-4.


2. The Department's Office of Defense Trade Controls
Compliance (PM/DTCC) requests Post's assistance in conducting
a post-shipment check on license 050099495 for the export of
International Traffic in Arms (ITAR) - controlled electronic
components and spare parts for the Manpack Radio Set
AN/PRC-77. Post is requested to complete this Blue Lantern
inquiry within 45 days. Lack of response to a Blue Lantern
inquiry will affect pending and future licenses involving
parties to this license.


3. Reason for request: Substantiate bona fides of foreign
parties involved in this transaction, confirm order/ receipt
with the end-user, and ensure United States Munitions List
(USML) items are being used in accordance with license
provisos. Foreign Intermediate Consignee Asia Projects is an
unfamiliar entity.


4. ACTION: The Department requests that Post make inquiries
with Foreign Intermediate Consignee Asia Projects to
establish its bona fides in the proposed transaction.
Conduct a site visit to assess the company's reliability as a
recipient of USML articles as well as its operations and
on-site security. Emphasize that the unauthorized re-export
or retransfer of USML items is strictly prohibited. Confirm
that the Bangladesh Army has received the USML items listed
below in full and that they are being used in accordance with
the license provisos which state that the items were approved
for all Bangladesh Army members except those in the
Bangladesh Rifles Unit (BDR) or the Rapid Action Battalion
(RAB).

The following questions provide suggested guidance:

(To Asia Projects):

- Can Asia Projects provide documentation (e.g. purchase
order, contract, or letter of intent) from the Bangladesh
Army, Signals Base Workshop firmly establishing it as the end
user of the items?

- What is Asia Project's exact role in this transaction?

- Who are Asia Project's other customers and where are they
located?

- What other products are sold by your company?

- How long has your company been in the business of importing
and selling defense articles?

- Are you familiar with the restrictions against the
unauthorized re-export or retransfer of U.S.-origin defense
articles?

(To Bangladesh Army, Signals Base Workshop)

- Please confirm receipt of the listed items on license
application 050099495.

- How long has the Bangladesh Army done business with Asia
Projects?

- What is the specific role of Asia Projects in the proposed
transaction?

- What measures have been implemented by the Bangladesh Army
to ensure the USML items are being used in accordance with
the license provisos?

The items ordered are the spares for Manpack Radio set
AN/PRC-77 to repair existing AN/RC-77 equipment for the
Bangladesh Army.
