RATIFICATION FOR THE U.S.-IAEA ADDITIONAL PROTOCOL


1. This is an Action Request. See paragraph 3 below.


2. Background: The Department is forwarding via Federal
Express (tracking number 8638 1698 3980) the U.S. Instrument
for Ratification to the Protocol Additional to the Agreement
Between the United States of America and the International
Atomic Energy Agency for the Application of Safeguards in the
United States of America, with annexes (the U.S.-IAEA
Additional Protocol) done at Vienna on June 12, 1998.
President Bush signed the instrument of ratification on
December 30, 2008. A copy of the instrument of ratification
is provided in paragraph 4 for the information of the Mission.


3. ACTION REQUESTED: Mission is requested to present, as
soon as practicable and with a goal of January 6, 2009, the
signed original instrument of ratification for the U.S.-IAEA
Additional Protocol to the IAEA Director General Mohamed
ElBaradei for deposit, along with the diplomatic note in
paragraph 5 below. If the Director General is unavailable,
Mission should provide the instrument of ratification to
another appropriate senior IAEA official. Mission should
report the date of deposit by telegram to the Department,
attention ISN/MNSA Stephen Adams, L/NPV Theodore Hirsch, and
L/T Lois Allder.

Instrument of Ratification (For Information Purposes Only):

TO ALL TO WHOM THESE PRESENTS SHALL COME, GREETING:

CONSIDERING THAT:

The Protocol Additional to the Agreement between the United
States of America and the International Atomic Energy Agency
for the Application of Safeguards in the United States of
America, with Annexes, was signed at Vienna June 12, 1998; and

The Senate of the United States of America by its resolution
of March 31, 2004, two-thirds of the Senators present
concurring therein, gave its advice and consent to
ratification of the Protocol;

NOW, THEREFORE, I, George W. Bush, President of the United
States of America, ratify and confirm the said Protocol.

IN TESTIMONY WHEREOF, I have signed this instrument of
ratification and caused the Seal of the United States of
America
to be affixed.

5. BEGIN TEXT OF A DIPLOMATIC NOTE FROM THE US MISSION TO THE
DIRECTOR GENERAL OF THE INTERNATIONAL ATOMIC ENERGY AGENCY:

(complimentary opening) and refers the Director General to
the Protocol Additional to the Agreement between the United
States of America and the International Atomic Energy Agency
for the Application of Safeguards in the United States of
America, with Annexes, signed at Vienna June 12, 1998 (the
Protocol).

The Mission transmits herewith the United States instrument
of ratification of the Protocol. The signature of this
instrument completes the statutory and constitutional
requirements of the United States of America for entry into
force of the Protocol.

In accordance with Article 17 (a) of the Protocol, the
Protocol will enter into force on the date of receipt of this
notification by the International Atomic Energy Agency.

The Mission would appreciate a note from the Director General
informing the Mission of the date of receipt of this note by
the IAEA, and thus the date of entry into force of the
Protocol.

dated/initialed U.S. note and a copy of the IAEA note to the
