1. USUN may draw from the following talking points as needed
for the February 12 meeting on the probable indictment of
Sudanese President Bashir by the ICC.

Begin points:

-- President Obama has long made clear his deep interest in
seeing an end to the horrors in Darfur and an end to the
culture of impunity in Sudan.

-- It is in our country's interest and that of the
international community that the perpetrators of heinous
crimes in Darfur are held accountable.

-- We are determined to pursue long-term peace in the region,
ensure the ongoing delivery of humanitarian assistance, and
improve the protection of civilians.

-- Nearly seven months have past since the ICC Chief
Prosecutor filed for an arrest warrant for President Bashir.
During this time the Government of Sudan has done little to
improve the situation in Darfur. We see no reason to support
deferral of the indictment of President Bashir.

-- We cannot allow action by the ICC to distract us from
larger goals in Sudan. It is critical we remain focused on
making progress on the UN/AU led Darfur peace process under
Djibril Bassole, full deployment of the UN/AU Mission in
Darfur (UNAMID),and implementation of the Comprehensive
Peace Agreement (CPA),including the conduct of credible
national elections in 2009.

-- We urge restraint on the part of all interested parties,
including the Government of Sudan. The Government of Sudan
should prevent and deter violence in all cases, including
against foreign interests, humanitarian aid workers, UNAMID,
or civilians in Sudan. It would be wholly unacceptable for
the Government of Sudan in any way to condone or instigate
such violence.
