1. (U) This is an action message. Please see para 2.


2. (S) Post should approach the relevant ROYG officials to inform
them of the pending return of six Yemeni nationals currently detained
at Guantanamo who have been approved for transfer. The detainees
are:

--Farouq Ali Ahmed (ISN YM-032)
--Riyadh Atiq Ali Abu al-Hajj (ISN YM-256)
--Ayman Saeed Abdullah Batarfi (ISN YM-627)
--Ahmed Ali Muhammed Taher (ISN YM-679)
--Fayyed Yahya Ahmed al-Rami (ISN YM-683)
--Jamal Muhammed al-Wai (ISN YM-577)

APSHCT John Brennan discussed the return of the six detainees to
Yemen with President Salih on December 4. The detainees are
scheduled to be returned to Yemen on or about December 19. Their
names were passed to the Yemeni Embassy in Washington on December 7.


3. (S) The following points were conveyed by APSHCT Brennan to
Ambassador al-Hajjri on December 2. Post should draw from these
points when informing the ROYG of the return of the Yemeni detainees.

(BEGIN POINTS)

--We plan to return to Yemen a small group of your nationals
currently detained at Guantanamo later this month.

--Farouq Ali Ahmed (ISN YM-032)

--If we see that these individuals are successfully reintegrated into
Yemeni society and the threats they may pose are mitigated by careful
monitoring, we will have something to build upon - which may result
in similar transfers in the months ahead. However, if there should
be a problem monitoring these returned detainees, it will make it
extremely difficult for the majority of transfers to proceed.

--It is in the mutual interest of our governments to work closely on
the implementation of security measures to mitigate the risks
presented by the return of these individuals. Specifically, we
expect your government to inform the U.S. Embassy once these
individuals are released following their transfer, and to provide
their location and circumstances. We also expect your government to
monitor these individuals and provide, at a minimum, monthly updates
to the Embassy. In addition, under certain circumstances - such as
when your government learns that any of the detainees are associating
with known extremists, we expect you to notify the Embassy
immediately.

--A team of experts, led by the Executive Director of the Guantanamo
Review Task Force, may travel to Sana'a in January. These experts
plan to discuss in further detail our cooperation on issues of
returning detainees and means to mitigate security concerns and we
hope that your government will receive them. I will provide further
details on this trip to you at a later date.
