1. FOLLOWING IS GUIDANCE FOR THE USDEL TO THE 46TH SESSION
OF THE SCIENTIFIC AND TECHNICAL SUBCOMMITTEE (STSC) OF THE
UN COMMITTEE ON THE PEACEFUL USES OF OUTER SPACE
(COPUOS). THIS SESSION OFFERS NEW POSSIBILITIES TO
ADVANCE U.S. INTERESTS IN COPUOS AND ITS SUBCOMMITTEES.
SINCE UNISPACE III IN 1999, THE WORK OF UNCOPUOS, AND
PARTICULARLY THE STSC, HAS COMPLEMENTED A NUMBER OF USG
PRIORITIES IN INTERNATIONAL SPACE COOPERATION. COPUOS
MEMBERS WILL CONTINUE TO DRAW UPON THE UNISPACE III REPORT
AND ITS RECOMMENDATIONS, AND THE 2004 REPORT TO THE UNGA
ON PROGRESS ACHIEVED IN IMPLEMENTING THE RECOMMENDATIONS
OF UNISPACE III (A/59/174),IN FORMULATING PROPOSALS FOR
NEW AGENDA ITEMS AND OTHER COPUOS-SPONSORED ACTIVITIES.
USDEL SHOULD TAKE ADVANTAGE OF OPPORTUNITIES TO SHOW
LINKAGES BETWEEN USG SPACE ACTIVITIES AND THE THEMES IN
THESE REPORTS.


2. SPACE APPLICATIONS PROGRAMME (SAP) AND IMPLEMENTATION
OF UNISPACE III:


3. GENERALLY, THE WORK OF THE SAP AND FOLLOW-UP TO
UNISPACE III SHOULD REFLECT THE THEMES BELOW. USDEL SHOULD
EVALUATE
SUGGESTED FUTURE AREAS OF WORK ON THE BASIS OF THESE
THEMES.

-- BROADER PARTICIPATION IN ACTIVITIES RELATED TO THE
MONITORING AND UNDERSTANDING OF THE EARTH AND ITS
ENVIRONMENT;

-- BETTER USE OF EXISTING MECHANISMS FOR INTERNATIONAL
COOPERATION, E.G., THE COMMITTEE ON EARTH OBSERVATION
SATELLITES (CEOS),THE INTER-AGENCY SPACE DEBRIS
COORDINATION COMMITTEE (IADC),AND THE GROUP ON EARTH
OBSERVATIONS (GEO);

-- DISSEMINATION OF INFORMATION ON SPACE RESEARCH AREAS
AND STRATEGIES FOR DEVELOPING COUNTRIES;

-- IMPROVED COORDINATION AND LESS DUPLICATION AMONG UN
ORGANIZATIONS INVOLVED IN SPACE ACTIVITIES;

-- STRENGTHENED REGIONAL SPACE COOPERATION;

-- PROMOTION OF CIVIL AND COMMERCIAL APPLICATIONS AND USE
OF OUTER SPACE; AND

-- GREATER INVOLVEMENT OF YOUNG SCIENTISTS AND ENGINEERS,
AS WELL AS INDUSTRY, IN SAP ACTIVITIES.

-- THERE IS A POSSIBILITY THAT OTHER DELEGATIONS WILL
COMMENT ON OR SEEK TO DISCUSS REVIEWING OR CHANGING THE UN
PRINCIPLES RELATING TO REMOTE SENSING OF THE EARTH FROM

OUTER SPACE. IN THAT EVENT THE USDEL SHOULD STRESS THAT
THE PRINCIPLES RELATING TO REMOTE SENSING OF THE EARTH FROM
OUTER SPACE ARE WORKING WELL AND DO NOT NEED TO BE
REVIEWED OR CHANGED; AND THE USDEL MAY NOT SUPPORT ANY MOVE TO
DISCUSS, STUDY, REVIEW OR CHANGE THE PRINCIPLES RELATING
TO REMOTE SENSING OF THE EARTH FROM OUTER SPACE.


4. STSC CONSIDERATION OF SPACE SYSTEMS-BASED DISASTER
MANAGEMENT SUPPORT: AT ITS 2006 SESSION, THE STSC
RECOMMENDED THE ESTABLISHMENT OF THE UN PLATFORM FOR
SPACE-BASED INFORMATION FOR DISASTER MANAGEMENT AND
EMERGENCY RESPONSE (SPIDER). SPIDER WAS ENDORSED BY
COPUOS AND THE UNGA AND HAS BEEN ESTABLISHED AS A PROGRAM
UNDER THE UN OFFICE OF OUTER SPACE AFFAIRS (UNOOSA) AND
WILL REPORT TO AND RECEIVE GUIDANCE FROM COPUOS THROUGH
UNOOSA. SPIDER IS BEING DESIGNED TO PROVIDE ACCESS FOR
ALL COUNTRIES AND RELEVANT INTERNATIONAL ORGANIZATIONS TO
SPACE-BASED INFORMATION AND SERVICES RELEVANT TO DISASTER
MANAGEMENT, TO SERVE AS A BRIDGE CONNECTING THE DISASTER
MANAGEMENT AND SPACE COMMUNITIES, AND TO FACILITATE
CAPACITY-BUILDING, PARTICULARLY IN DEVELOPING COUNTRIES.

THE PROGRAM IS INTENDED TO WORK CLOSELY WITH
INTERNATIONAL INITIATIVES SUCH AS THE GLOBAL EARTH
OBSERVATION SYSTEM OF SYSTEMS, THE INTERNATIONAL CHARTER
ON SPACE AND MAJOR DISASTERS, THE IAEA INCIDENT AND
EMERGENCY CENTER, AND THE INTERNATIONAL STRATEGY FOR
DISASTER REDUCTION IN ORDER TO AVOID DUPLICATION OF
EFFORTS. UNCOPUOS HAD AGREED THAT THE PROGRAM WAS TO BE
SUPPORTED BY VOLUNTARY CONTRIBUTIONS AND THROUGH A
REARRANGEMENT OF UNOOSA PRIORITIES. THE U.S. JOINED
CONSENSUS ON THE ESTABLISHMENT OF SPIDER WITH THE
UNDERSTANDING THAT THE ADDITIONAL ACTIVITIES ASSOCIATED
WITH SPIDER WOULD NOT, AS FAR AS POSSIBLE, HAVE A NEGATIVE
IMPACT ON THE CURRENT PROGRAM ACTIVITIES OF UNOOSA NOR ON
THE UN REGULAR BUDGET AS REFLECTED IN UNGA 61/110. HOWEVER
AT THE 2007 UNGA, A RESOLUTION WAS PASSED CALLING FOR AN
ADDITIONAL $600,000 FROM THE UN REGULAR BUDGET FOR SPIDER
STAFF. THE U.S. DISASSOCIATED ITSELF FROM THE RESOLUTION
AND MADE A STATEMENT FOR THE RECORD EXPRESSING OUR
UNHAPPINESS WITH THE IMPACT ON THE BUDGET. THE LANGUAGE
IN OUR STATEMENT WAS SUPPORTED BY AUSTRIA AND GERMANY WITH
COMPLICIT SUPPORT OF THE CHAIR, BRACHET. AUSTRIA, CHINA,
GERMANY, AND SWITZERLAND ARE PROVIDING DIRECT SUPPORT TO
SPIDER. WE HAVE STATED THAT USG AGENCIES RESPONSIBLE FOR
DISASTER EARLY WARNING AND MITIGATION WILL NOT CONTRIBUTE
RESOURCES TO SPIDER, BUT THAT THEIR PRODUCTS WILL BE MADE
AVAILABLE AS THEY HAVE BEEN IN THE PAST IN RESPONSE TO
DISASTER SITUATIONS.

AT THIS SESSION, THE USDEL SHOULD:


A. REITERATE THAT THE U.S. DOES NOT SUPPORT AN INCREASE IN
THE BUDGET FOR SPIDER.


B. REITERATE THAT USG AGENCIES RESPONSIBLE FOR DISASTER
EARLY WARNING AND MITIGATION DO NOT PLAN TO CONTRIBUTE
RESOURCES
TO SPIDER, BUT THAT THEIR PRODUCTS WILL BE MADE AVAILABLE,
AS THEY HAVE BEEN IN THE PAST, IN RESPONSE TO DISASTER
SITUATIONS.


5. SOLAR TERRESTRIAL PHYSICS: ON THE BASIS OF A U.S.
PROPOSAL AT THE 2005 SESSION OF THE STSC, THE SUBCOMMITTEE
CONSIDERED THE INTERNATIONAL HELIOPHYSICAL YEAR (IHY) 2007
UNDER A MULTI-YEAR WORK PLAN. THE WORK PLAN WAS
COMPLETED IN 2008, BUT THE SUBCOMMITTEE AGREED TO RETAIN
THIS AS A SINGLE-ISSUE ITEM FOR DISCUSSSION IN 2009. AT
THIS SESSION, THERE WILL BE A REPORT BY THE IHY
SECRETARIAT ON THE WRAP-UP OF IHY 2007 AND PLANS TO
CONTINUE RESEARCH WITH IHY INSTRUMENTS. UNDER THIS AGENDA
ITEM, USDEL SHOULD PROPOSE THAT THE TOPIC OF SPACE WEATHER
MONITORING AND FORECASTING REPLACE IHY 2007 AS A SINGLE
ISSUE/ITEM FOR 2010 OR AS A MULTIYEAR AGENDA ITEM BASED ON
A WORK PLAN PROPOSED BY NASA AND NOAA.


6. SPACE DEBRIS: AT ITS 44TH SESSION, THE SUBCOMMITTEE
REACHED CONSENSUS ON A VOLUNTARY SET OF SPACE DEBRIS
MITIGATION GUIDELINES BASED ON THE GUIDELINES PRODUCED BY
THE INTER-AGENCY SPACE DEBRIS COORDINATION COMMITTEE
(IADC) IN 2002. THESE STSC GUIDELINES WERE SUBSEQUENTLY
ENDORSED BY COPUOS AND THE UNGA DURING THEIR 2007
SESSIONS. THIS YEAR, SPACE DEBRIS WILL CONTINUE AS A
SINGLE ISSUE ITEM, WITH VOLUNTARY MEMBER STATE REPORTING
ON IMPLEMENTATION OF THE SPACE DEBRIS GUIDELINES THROUGH
NATIONAL MECHANISMS. SPECIAL PRESENTATIONS ON THE STATE
OF THE DEBRIS ENVIRONMENT AND UPDATES ON RESEARCH
CONCERNING ORBITAL DEBRIS WILL BE GIVEN BY EXPERTS FROM
NASA AND THE IADC.

THE USDEL SHOULD:


A. REQUEST THAT MEMBER STATES BEGIN VOLUNTARY ANNUAL
REPORTING OF NATIONAL ACTIVITIES TO IMPLEMENT SPACE DEBRIS
MITIGATION MEASURES;


B. OPPOSE THE CREATION OR ADDITION OF LEGALLY BINDING
MEASURES CONCERNING ORBITAL DEBRIS BY THE STSC, LSC,
COPUOS, OR UNGA; AND


C. OPPOSE THE CREATION OF UNGA PRINCIPLES ON ORBITAL
DEBRIS.


7. NUCLEAR POWER SOURCES IN SPACE: AT ITS FORTY-FIFTH
SESSION IN 2008, THE STSC CONTINUED WORK ON THE WORK PLAN
TO DEVELOP, IN CONJUNCTION WITH THE IAEA, A
TECHNICALLY-BASED FRAMEWORK OF GOALS AND RECOMMENDATIONS
FOR THE SAFETY OF NUCLEAR POWER SOURCE (NPS) APPLICATIONS
IN OUTER SPACE (HEREAFTER REFERRED TO AS THE FRAMEWORK.)
CONSISTENT WITH THE WORK PLAN, A JOINT EXPERTS GROUP (JEG)
COMPRISING TECHNICAL EXPERTS FROM STSC MEMBER STATES, THE
EUROPEAN SPACE AGENCY AND IAEA MET TO DEVELOP A DRAFT
SAFETY FRAMEWORK FOR REVIEW BY THE SUBCOMMITTEE AND THE
IAEA. THE JEG MET IN JUNE AND OCTOBER 2008 TO UPDATE THE
DRAFT FRAMEWORK BASED ON COMMENTS FROM STSC MEMBER STATES,
ESA AND THE IAEA. A FINAL DRAFT OF THE FRAMEWORK WAS
DEVELOPED BY THE JEG AT THE OCTOBER 2008 MEETING AND
SUBMITTED TO THE OOSA SECRETARIAT FOR DISTRIBUTION PRIOR
TO THE FEBRUARY 2009 MEETING.


8. AT THIS STSC SESSION, THE USDEL SHOULD LEAD AN EFFORT
TO ACHIEVE CONSENSUS WITHIN THE JEG FOR THE CHANGE
SPECIFIED IN THE FOLLOWING PARAGRAPH. ONCE THAT CHANGE
HAS BEEN ADOPTED, THE USDEL SHOULD LEAD AN EFFORT TO
ACHIEVE CONSENSUS WITHIN THE STSC NPS WORKING GROUP tTO
HAVE THE CONSENSUS VERSION APPENDED TO THE NPS WORKING
GROUP REPORT TO THE STSC WITH APPROPRIATE REPORT LANGUAGE
THAT MAKES IT CLEAR THAT THE FRAMEWORK IS BEFORE THE STSC
FOR APPROVAL AND FORWARDING TO THE IAEA. AFTER THE STSC
HAS APPROVED THE FRAMEWORK, IT WILL BE PROVIDED TO THE
IAEA COMMISSION ON SAFETY STANDARDS FOR THEIR ENDORSEMENT
AT THEIR UPCOMING APRIL 22-24, 2009, MEETING IN VIENNA.
IF EITHER THE JEG OR STSC FAIL TO REACH CONSENSUS ON THE
FRAMEWORK, THE USDEL WILL RECOMMEND THAT THE STATUS OF THE
FRAMEWORK IS ADDRESSED DURING THE INTERSESSIONAL MEETING
IN JUNE 2009.


9. SUBJECT TO THE SPECIFIED CAVEATS, THE USDEL WILL WORK
IN THE JEG TO MAKE THE FOLLOWING CHANGE TO THE VERSION OF
THE FRAMEWORK DISTRIBUTED BY THE OOSA SECRETARIAT PRIOR TO
THE CURRENT STSC MEETING:

- TO ACHIEVE FRENCH AND EUROPEAN CONSENSUS ON THE
FRAMEWORK, CHANGE THE WORDING OF THE PREFACE, SIXTH
PARAGRAPH,LAST SENTENCE TO: &THE DEVELOPMENT OF THIS
FRAMEWORK TOOK INTO CONSIDERATION, BUT DOES NOT
SUPPLEMENT, ALTER OR INTERPRET, RELEVANT CONVENTIONS,
INTERNATIONAL LAW AND PRINCIPLES.8


10. OTHER THAN THE CHANGE NOTED IN THE PREVIOUS PARAGRAPH,
THE USDEL SHALL NOT AGREE TO ANY CHANGES TO THE CURRENT
DRAFT OF THE FRAMEWORK THAT WOULD SUBSTANTIVELY ALTER THE
CONTENT OF THE DOCUMENT OR BE INCONSISTENT WITH THE
DRAFTING AND CONTENT GUIDELINES INCLUDED IN THE WORK PLAN
(AND THE COUNTERPART IAEA DOCUMENT PREPARATION PROFILE).


11. BASED ON STSC MEMBER STATE REVIEW COMMENTS ON THE
FRAMEWORK AND DISCUSSIONS HELD AT THE OCTOBER 2008 JEG
MEETING, THE TOPICS LISTED BELOW COULD BE RAISED DURING
THE FEBRUARY 2009 MEETING OF THE JEG AND/OR STSC NPS
WORKING GROUP. FOR EACH OF THE LISTED TOPICS, THE US DEL
WILL SEEK TO ACHIEVE CONSENSUS WITHIN THE JEG AND STSC NPS
WORKING GROUP ON THE DESIRED OUTCOME:


A. THE ROLE OF THE IAEA RELATIVE TO NPS ONCE THE
FRAMEWORK IS APPROVED.
DESIRED OUTCOME: AGREEMENT THAT INTERNAL
DELIBERATIONS WITHIN THE IAEA AND AMONG ITS MEMBER STATES,
AND CONSULTATIONS WITH THE STSC WOULD BE NEEDED TO
DETERMINE THE IAEA,S ROLE AFTER THE FRAMEWORK IS APPROVED.


B. THE ROLE OF THE COPUOS ONCE THE FRAMEWORK IS APPROVED.
DESIRED OUTCOME: AGREEMENT THAT A NEW NPS WORKING GROUP
WORK PLAN, APPROVED BY THE STSC, WOULD BE REQUIRED FOR
ADDITIONAL WORK ON NPS BEYOND THAT OF THE CURRENT WORK
PLAN.


C. THE RELATIONSHIP OF THE FRAMEWORK TO THE UN PRINCIPLES
RELEVANT TO THE USE OF NUCLEAR POWER SOURCES IN OUTER
SPACE (RESOLUTION 47/68 OF 14 DECEMBER 1992, AND HEREAFTER
REFERRED TO AS &THE PRINCIPLES8).

DESIRED OUTCOME: AGREEMENT THAT THE FRAMEWORK IS
AN INDEPENDENT MECHANISM THAT DELINEATES THE GOVERNMENTAL,
MANAGEMENT AND TECHNICAL ELEMENTS THAT SHOULD COMPRISE A
NATIONAL INFRASTRUCTURE FOR IMPLEMENTING SAFE APPLICATIONS
OF SPACE NPS AND, AS SUCH, SPECIFIES THE ELEMENTS REQUIRED
BY NATIONAL GOVERNMENTS TO EFFECTIVELY IMPLEMENT OTHER
RELEVANT GUIDANCE, SUCH AS THAT FOUND IN THE PRINCIPLES.


D. APPLICATION OF THE FRAMEWORK TO COMMERCIAL AND DEFENSE
MISSIONS.
DESIRED OUTCOME: AGREEMENT THAT THE FRAMEWORK IS
APPLICABLE TO ALL PEACEFUL USES OF SPACE NPS.


E. THE RATIONALE FOR RESTRICTING THE APPLICATION OF THE
FRAMEWORK TO THE PROTECTION OF PEOPLE AND ENVIRONMENTS ON
EARTH.
DESIRED OUTCOME: AGREEMENT THAT WHILE A
SUBSTANTIAL SCIENTIFIC BODY OF KNOWLEDGE EXISTS FOR
ESTABLISHING A SPACE NPS APPLICATION SAFETY FRAMEWORK FOR
PEOPLE AND THE ENVIRONMENT IN EARTH,S BIOSPHERE,
COMPARABLE SCIENTIFIC DATA DOES NOT YET EXIST THAT WOULD
PROVIDE A TECHNICALLY SOUND BASIS FOR DEVELOPING A SPACE
NPS APPLICATION SAFETY FRAMEWORK FOR PROTECTING HUMANS IN
THE UNIQUE CONDITONS IN SPACE AND ENVIRONMENTS OUTSIDE OF
THE EARTH,S BIOSPHERE.


F. THE LACK OF MORE DETAILED DESIGN AND DEVELOPMENT
GUIDANCE IN SECTION 5.2 OF THE FRAMEWORK.
DESIRED OUTCOME: AGREEMENT THAT THE GUIDANCE
PRESENTED IN THE FRAMEWORK FOR &SAFETY IN DESIGN AND
DEVELOPMENT8 IS SUBSTANTIVE, AND CONSISTENT WITH BOTH THE
GUIDANCE FOR FRAMEWORK DEVELOPMENT AS SPECIFIED IN THE
WORK PLAN (AND IAEA DOCUMENT PREPARATION PROFILE) AND WITH
THE LEVEL-OF-DETAIL FOUND IN AN IAEA SAFETY FUNADAMENTAL
(A DOCUMENT AKIN TO THE FRAMEWORK).


G. THE ABSENCE OF A PROHIBITION AGAINST USE OF
NUCLEAR REACTORS IN EARTH ORBIT.
DESIRED OUTCOME: AGREEMENT THAT THE FRAMEWORK IS
NON-BINDING AND PROVIDES A SET OF TOP LEVEL BEST PRACTICES
FOR DEVELOPING A SAFETY CULTURE AND INFRASTRUCTURE WITHIN
A SPACE PROGRAM; AS SUCH, IT IS INTENDED TO BE UTILIZED AS
A GUIDE FOR NATIONAL PURPOSES AND IS INTENDED TO APPLY TO
ALL SPACE NPS APPLICATIONS WITHOUT PREJUDICE. CONSISTENT
WITH THE WORK PLAN FOR THE FRAMEWORK THAT WAS ADOPTED BY
THE STSC NPS WORKING GROUP, &THE SAFETY FRAMEWORK SHOULD
BE GENERAL AND QUALITATIVE IN NATURE, TECHNICALLY VALID
AND RELATIVELY INDEPENDENT OF EVOLVING TECHNOLOGY. THE
GUIDELINES SET FORTH IN THE FRAMEWORK SHOULD REFLECT BROAD
INTERNATIONAL CONSENSUS8 (REF: (A/AC.105/C.1/L289,
DEVELOPMENT OF AN INTERNATIONAL TECHNICALLY BASED
FRAMEWORK OF GOALS AND RECOMMENDATIONS FOR THE SAFETY OF
PLANNED AND CURRENTLY FORESEEABLE NUCLEAR POWER SOURCE
APPLICATIONS IN OUTER SPACE, 27 DECEMBER 20068).
MOREOVER, IF SPACE REACTORS WERE EXCLUDED FROM THIS
FRAMEWORK, THEN NO ASPECT OF THE FRAMEWORK WOULD APPLY TO
SPACE REACTOR APPLICATIONS ) A RESULT THAT WOULD RUN
COUNTER TO ASSURING THE SAFETY OF SPACE NPS.


12. IF THE FRAMEWORK IS APPROVED BY THE STSC, THEN
THE USDEL CAN AGREE TO CONSIDERATION OF A NEW NPS WORK

13. IF THE FRAMEWORK IS APPROVED BY THE STSC, THE
POSSIBILITY EXISTS THAT ONE OR MORE WORKING GROUP MEMBERS
COULD PROPOSE THAT THE TIME IS NOW APPROPRIATE FOR
RE-EVALUATING AND/OR MODIFYING THE 1992 PRINCIPLES. USDEL
SHALL NOT AGREE TO ANY DISCUSSION OF THE STATUS OF THE
PRINCIPLES BUT SHOULD DEFER THE DISCUSSION OF THIS TOPIC
UNTIL A POSSIBLE INTERSESSIONAL MEETING IN JUNE TO PLAN A
WORKSHOP IN 2010 (SEE PREVIOUS PARAGRAPH 12). IF OTHER
DELEGATIONS COMMENT ON OR SEEK TO INTRODUCE PROPOSALS FOR
REVISION OF THE UN PRINCIPLES, THE USDEL SHALL DRAW ON THE
FOLLOWING POINTS:


A. THE STSC HAS AGREED THAT, AT THE PRESENT TIME,
REVISION OF THE PRINCIPLES IS NOT WARRANTED. IT HAS ALSO
AGREED THAT A FIRM SCIENTIFIC AND TECHNICAL FOUNDATION
SHOULD BE ESTABLISHED PRIOR TO POTENTIAL FUTURE
DISCUSSIONS OF THE PRINCIPLES. FURTHER, IT HAS NOTED THAT
IT WOULD BE INAPPROPRIATE TO REFER THE TOPIC TO THE LEGAL
SUBCOMMITTEE BEFORE SUCH TECHNICAL FOUNDATION IS
ESTABLISHED; AND


B. THE LEGAL SUBCOMMITTEE (LSC) HAS DECIDED TO SUSPEND
CONSIDERATION IN ITS WORKING GROUP OF THE PRINCIPLES.


14. THE USDEL SHALL NOT ACTIVELY ENGAGE IN FORMAL DEBATE
ON PROPOSALS OF OTHER DELEGATIONS FOR ADDITIONS TO, OR
ELABORATION OF, THE PRINCIPLES AND SHOULD NOT JOIN
CONSENSUS ON ANY SUCH PROPOSALS. IN PARTICULAR, THE USDEL
SHALL NOT AGREE TO A DISCUSSION OF THE CURRENT PRINCIPLES
IN THE FRAMEWORK. IF ASKED,

-- THE UNITED STATES HAS DETERMINED THAT WHILE THE
PRINCIPLES HAVE NO BINDING EFFECT ON NATIONAL PROGRAMS,
U.S. POLICY AND PRACTICE ARE FULLY CONSISTENT WITH THE

ASSIST IN PLANNING FOR FUTURE UN MEETINGS.


16. NEAR-EARTH OBJECTS (NEO): THIS TOPIC IS BEING
CONSIDERED UNDER A MULTI-YEAR WORK PLAN. THIS YEAR,
MEMBER STATES ARE INVITED TO REPORT ON NATIONAL, REGIONAL
AND INTERNATIONAL COLLABORATIVE ACTIVITIES FOR OBSERVATION
AND ANALYSIS OF NEAR-EARTH OBJECTS. THE U.S. WILL PROVIDE
A STATEMENT AND SPECIAL PRESENTATION ON THIS TOPIC TO
INCLUDE DETAILS ON RELATED U.S. RESEARCH EFFORTS,
INCLUDING NASA SPACE AND GROUND RESEARCH. AT THIS
SESSION, THE NEO WORKING GROUP AND THE STSC WILL LIKELY
HEAR A RECOMMENDATION FROM THE ASSOCIATION OF SPACE
EXPLORERS (ASE) FOR THE UN TO ESTABLISH AN INTERNATIONAL
DECISION-MAKING BODY TO ADDRESS INTERNATIONAL OR GLOBAL
THREATS FROM NEOs THAT ARE EXPECTED TO IMPACT THE EARTH.
THE USG DOES NOT SUPPORT THE CREATION OF NEW UN BODIES
WITHOUT A COMPELLING JUSTIFICATION, NOR IS IT PRESENTLY IN
A POSITION TO FINANCIALLY SUPPORT ANY NEW GROUPS. IN
ADDITION, THE USG HAS NOT ESTABLISHED A POSITION ON AN
INTERNATIONAL DECISION-MAKING BODY TO ADDRESS NEO IMPACT
THREATS. THE DELEGATION SHOULD FOCUS THE WORKING GROUP,S
ATTENTION ON HOW MEMBER STATES CAN INCREASE CAPABILITIES
TO DETECT AND TRACK POTENTIALLY HAZARDOUS NEOS, EXCHANGE
DATA ON THEIR ORBITS AND FUTURE POSITION, AND PREPARE
MECHANISMS TO RAPIDLY PROVIDE INFORMATION TO GOVERNMENTS
SHOULD A POTENTIAL EARTH IMPACTING OBJECT BE IDENTIFIED.
THE DELEGATION MAY ENGAGE IN DISCUSSION ON THIS PARTICULAR
ASPECT OF NEOS AND CONSULT WITH WASHINGTON BEFORE JOINING
CONSENSUS ON ANY DECISIONS RELATED TO THE ESTABLISHMENT OF
SUCH A BODY.


17. RECENT DEVELOPMENTS IN GLOBAL NAVIGATION SATELLITE
SYSTEMS: AT ITS 44TH SESSION, THE STSC AGREED TO ADD TO
ITS AGENDA AN ITEM DEALING WITH RECENT DEVELOPMENTS IN
GLOBAL NAVIGATION SATELLITE SYSTEMS AND THEIR
APPLICATIONS. THIS ITEM WILL PROVIDE AN OPPORTUNITY FOR
SYSTEM OPERATORS TO REPORT ON THE STATUS OF THEIR
PROGRAMS. IT WILL ALSO SERVE TO BRING MEMBER STATES UP TO
DATE ON THE WORK OF THE INTERNATIONAL COMMITTEE ON GNSS
AND THE PROVIDERS FORUM. USDEL WILL DELIVER A STATEMENT ON
THE STATUS OF GPS AND EFFORTS BEING UNDERTAKEN
INTERNATIONALLY TO PROMOTE THE USE OF GPS.


18. BEST PRACTICES FOR SAFE SPACE OPERATIONS: AT THE 50TH
SESSION OF THE FULL COPUOS, CHAIRMAN BRACHET PRESENTED A
COMPREHENSIVE ASSESSMENT OF THE FUTURE ACTIVITIES OF
COPUOS ENTITLED, "FUTURE ROLES AND ACTIVITIES OF THE
COMMITTEE ON THE PEACEFUL USES OF OUTER SPACE." BRACHET
BELIEVES THAT COPUOS NEEDS TO PLAY ITS ROLE IN SHAPING THE
INTERNATIONAL STANDARDS FOR SPACE ACTIVITIES AND IN
PROMOTING INTERNATIONAL COOPERATION IN AREAS SUCH AS
RESEARCH, APPLICATIONS, OPERATIONS, AND EXPLORATION. HE
BELIEVES THAT COPUOS SHOULD ALSO LOOK AT THE LONGER TERM
ISSUES FACING THE FUTURE PEACEFUL USES OF OUTER SPACE AND
IDENTIFY WHERE THE COMMITTEE CAN BEST CONTRIBUTE TO THE
SUSTAINABILITY OF SPACE ACTIVITIES AND TO THEIR FUTURE
PROGRESS FOR THE BENEFIT OF ALL.

LONG-TERM SUSTAINABILITY OF SPACE ACTIVITIES: CHAIRMAN
BRACHET,S ASSESSMENT OF THE SUSTAINABILITY OF SPACE
ACTIVITIES SPECIFICALLY NOTED THE EXCELLENT WORK DONE BY
THE STSC IN THE DEVELOPMENT OF VOLUNTARY DEBRIS MITIGATION
GUIDELINES. THE ASSESSMENT NOTED THE LARGER NUMBERS OF
SPACE ACTORS AND SUGGESTED THAT IT IS IMPERATIVE TO AGREE
ON "RULES OF THE ROAD" TO AVOID INTERFERENCE, COLLISIONS,
AND OTHER MISHAPS, PARTICULARLY BY NEWCOMERS TO SPACE
OPERATIONS. BRACHET IS NOT SUGGESTING THAT THERE IS A
NEED TO MODIFY THE PRESENT TREATY REGIME, BUT RATHER TO
DEVELOP RECOMMENDATIONS TO DEAL WITH THE NEW REALITIES OF
SPACE OPERATIONS. TO FURTHER THIS CONCEPT, THE GOVERNMENT
OF FRANCE HOSTED AN INFORMAL CONSULTATION GROUP THAT MET
TWICE IN 2008 TO PRODUCE, IN COLLABORATION WITH RELEVANT
INTERGOVERNMENTAL ORGANIZATIONS AND REPRESENTATIVES OF THE
PRIVATE SECTOR, A TECHNICAL ASSESSMENT OF THE SITUATION
AND POTENTIAL FUTURE WORK IN THIS AREA FOR UNCOPUOS.

THE U.S. PARTICIPATED IN BOTH MEETINGS OF THE INFORMAL
CONSULTATIONS AND IS A MEMBER OF THE DRAFTING GROUP
ESTABLISHED THROUGH THESE CONSULTATIONS TO DOCUMENT THE
RESULTS. THE CONSULTATIONS INCLUDED A CROSS-SECTION OF
COPUOS MEMBER STATES, INTERNATIONAL ORGANIZATIONS, AND
COMMERCIAL SPACE OPERATORS. THOSE PARTICIPATING IN THE
MEETINGS AGREED TO CONTINUE THE EXCHANGE OF RELEVANT VIEWS
ON THIS SUBJECT WITH THE OBJECTIVE OF DRAFTING AN OUTLINE
DOCUMENT THAT COULD GUIDE FURTHER WORK IN THIS AREA BY THE
STSC, NO EARLIER THAN 2010. BRACHET INTENDS TO HAVE A
THIRD MEETING OF THE INFORMAL WORKING GROUP TO REVIEW THE
DRAFT REPORT AND DISCUSS THE POSSIBILITY OF INTRODUCING A
MULTI-YEAR WORK PLAN AT THE 2009 SESSION OF COPUOS FOR THE
STSC TO BEGIN WORK IN 2010. THAT PLAN WOULD CULMINATE IN
THE FINALIZATION OF A DOCUMENT ON "BEST PRACTICES FOR
SPACE OPERATIONS."

IN THE COURSE OF CONSIDERING THE FRENCH PROPOSAL, THE
USDEL SHOULD MAKE THE FOLLOWING POINTS IN ORDER TO ENSURE
THAT THE FUTURE WORK OF THE INFORMAL CONSULTATIONS AND ANY
PROPOSAL TO THE STSC IS PROPERLY FRAMED:

(1) FUTURE WORK WILL ADDRESS BEST PRACTICES ASSOCIATED
WITH SPACE OPERATIONS, PROCEDURES, AND POLICIES FROM
PRE-LAUNCH THROUGH END OF LIFE ACTIVITIES, (NOTE: THESE
EFFORTS SHOULD BEAR IN MIND, BUT NOT DUPLICATE OR REOPEN,
THE ACTIVITIES AND RECOMMENDATIONS BEING UNDERTAKEN IN THE
STSC WORKING GROUP ON NUCLEAR POWER SOURCES IN SPACE AND
THE WORK OF THE STSC AND IADC ON ORBITAL DEBRIS
MITIGATION. END NOTE);

(2) THE FUTURE WORK SHOULD INVOLVE INPUT FROM STATE
MEMBERS, SPACE-FARING NATION REPRESENTATIVES, COMMERCIAL
SPACE OPERATORS AND PROVIDERS ON THEIR BEST PRACTICES
ASSOCIATED WITH SAFE SPACE OPERATIONS, PROCEDURES, AND
POLICIES;

(3) FUTURE WORK COULD INCLUDE THE PREPARATION OF A
CONSOLIDATED LIST OF BEST PRACTICES ASSOCIATED WITH SAFE
SPACE OPERATIONS;

(4) FOR FUTURE REFERENCE: IN THE EVENT THAT IT IS AGREED
AT A FUTURE COPUOS THAT THE STSC WOULD DEVELOP VOLUNTARY
SAFE SPACE OPERATION GUIDELINES, THOSE GUIDELINES WOULD:
(a) BE NO MORE STRINGENT THAN THE ASSOCIATED EXISTING USG
POLICIES, PRINCIPLES, PROCEDURES, REGULATIONS, STANDARD
PRACTICES, AND GUIDELINES;
(b) REMAIN VOLUNTARY FOR EVERY STATE RESPONSIBLE FOR
SPACE ACTIVITIES AND NOT BE LEGALLY BINDING UNDER
INTERNATIONAL LAW;
(c) NOT PROVIDE SPECIFIC OR ADDITIONAL PENALTIES FOR
FAILING TO FOLLOW THE GUIDELINES, BEYOND THOSE ALREADY
PROVIDED UNDER INTERNATIONAL LAW;
(d) ENSURE THAT EACH PROPOSED GUIDELINE MAINTAINS OR
IMPROVES THE SAFETY OF SPACEFLIGHT OPERATIONS AND PROTECTS
THE SPACE ENVIRONMENT WITHOUT IMPOSING UNACCEPTABLE OR
UNREASONABLE COSTS; AND
(e) BE CONSISTENT WITH THE ACTIVITIES AND RECOMMENDATIONS
OF THE STSC WORKING GROUP ON NUCLEAR POWER SOURCES IN
SPACE, THE WORK AND RECOMMENDATIONS OF THE IADC AND THE
STSC CONCERNING ORBITAL DEBRIS MITIGATION AND THE UNCOPUOS
GUIDELINES ON ORBITAL DEBRIS MITIGATION.

(5) ANY WORK OF THE STSC WOULD NOT ADDRESS THE CURRENT
OUTER SPACE LEGAL REGIME OR ANY LEGAL QUESTIONS/ISSUES.
THE USG POSITION REMAINS THAT:
(a) THE 1967 OUTER SPACE TREATY, 1968 RESCUE AND RETURN
AGREEMENT, THE 1972 LIABILITY CONVENTION, AND THE 1975
REGISTRATION CONVENTION SHOULD BE ADOPTED AND FULLY
ADHERED TO BY ALL NATIONS;
(b) THE PRINCIPLES ESTABLISHED IN THESE AGREEMENTS HAVE
STOOD THE TEST OF TIME BECAUSE THEY CREATED THE
FUNDAMENTAL GUIDELINES REQUIRED FOR THE FREE ACCESS TO,
AND USE OF, OUTER SPACE FOR PEACEFUL PURPOSES; AND,
(c) THESE AGREEMENTS FORM THE LEGAL BASIS FOR ALL OUTER
SPACE OPERATIONS.

(6).FOR FUTURE CONSIDERATION: THE INTERNATIONAL CIVIL
AVIATION ORGANIZATION (ICAO),INTERNATIONAL
TELECOMMUNICATIONS UNION (ITU),EUROPEAN SPACE AGENCY
(ESA),AND EUMETSAT SHOULD BE INVITED TO SEND EXPERTS WITH
RELEVANT EXPERTISE IN SPACE OPERATIONS TO PARTICIPATE AS
OBSERVERS IN THE INFORMAL CONSULTATIONS AND FUTURE WORK OF
THE STSC.
(a) AN INVITATION TO THE ITU SHOULD EMPHASIZE THEIR
POSSIBLE CONTRIBUTIONS IN PROVIDING INFORMATION CONCERNING
THE ITU,S PROCESSES FOR COORDINATING USE BY GEOSTATIONARY
SATELLITES OF RADIO FREQUENCIES AND ASSOCIATED ORBITAL
LOCATIONS.
(b)INVITATIONS TO ESA AND EUMETSAT SHOULD NOTE THEIR
ROLE AS A LEADING INTERNATIONAL INTERGOVERNMENTAL
ORGANIZATION THAT HAVE DECLARED ACCEPTANCE OF RIGHTS AND
OBLIGATIONS UNDER THE LIABILITY AGREEMENT AND THE
REGISTRATION CONVENTION. THEY ARE BOTH PERMANENT OBSERVERS
IN COPUOS.

THE USG WILL OPPOSE ATTEMPTS AT COPUOS TO LIMIT USG
FREEDOM OF ACTION IN OUTER SPACE AND OR TO ESTABLISH
GENERAL PROHIBITIONS ON LEGTIMATE U.S. PEACEFUL SPACE
ACTIVITIES CONDUCTED IN PURSUIT OF NATIONAL INTERESTS.

THE USG WILL:

(11) CONTINUE TO VOLUNTARILY OFFER ITS UNCLASSIFIED SPACE
OBJECT TRACKING DATA, FREE OF CHARGE, TO NATIONS AS WELL
AS COMMERCIAL OPERATORS AND CIVIL SOCIETY;

(12) REMAIN OPEN ABOUT THE BASIC PRINCIPLES OF ITS
NATIONAL SPACE POLICIES:
(a) REAFFIRM ITS COMMITMENT TO THE PRINCIPLE OF FREE
ACCESS TO AND USE OF SPACE BY ALL/ALL NATIONS FOR PEACEFUL
PURPOSES;
(b)CONTINUE TO SEEK INTERNATIONAL COOPERATION WITH OTHER
NATIONS IN THE PEACEFUL USES OF OUTER SPACE;
(c). REMAIN READY TO WORK WITH OTHER NATIONS TO EXTEND THE
BENEFITS OF SPACE, TO ENHANCE SPACE EXPLORATION, AND TO
USE SPACE TO PROTECT AND PROMOTE FREEDOM AROUND THE WORLD;
AND
(d)REQUEST THAT OTHER NATIONS DEMONSTRATE SIMILAR
TRANSPARENCY REGARDING THEIR OWN SPACE POLICIES,
PROCEDURES, ACTIVITIES AND INTENTIONS IN OUTER SPACE.



19. ARMS CONTROL: THE ISSUE OF SPACE ARMS CONTROL MAY BE A
MAJOR ISSUE GIVEN THE NEW U.S. ADMINISTRATION. IF THIS
OCCURS, USDEL SHOULD STRESS THAT COPUOS IS CONCERNED
EXCLUSIVELY WITH INTERNATIONAL COOPERATION IN THE PEACEFUL
USES OF OUTER SPACE, AS INDICATED BY ITS TITLE. THE FIRST
COMMITTEE OF THE UNGA (DISARMAMENT AND INTERNATIONAL
SECURITY) AND THE CD WOULD BE THE MORE APPROPRIATE
MULTILATERAL FORA TO DISCUSS ARMS CONTROL MATTERS RELATED TO
OUTER SPACE. OUR OBJECTIVE IN COPUOS AND ITS SUBCOMMITTEES
IS TO UNDERSCORE THE UNPRECEDENTED INTERNATIONAL SPACE
COOPERATION NOW UNDERWAY AND REINFORCE RESISTANCE TO
INCREASING CALLS IN THE CD FOR NEGOTIATIONS ON OUTER SPACE.

ISSUE, BUT SOME DELEGATIONS MAY SEEK CLARIFICATION OF THE NEW
ADMINISTRATION'S POSITION. THESE REQUESTS FOR CLARIFICATION

COUNCIL OF THE EUROPEAN UNION (REFTEL C). IF RAISED, USDEL
MAY DRAW UPON THE FOLLOWING POINTS AS NECESSARY:

-- THE UNITED STATES WILL PLAY A LEADING ROLE IN ADVANCING
TRANSPARENCY AND CONFIDENCE BUILDING MEASURES (TCBMS)
RELATING TO SPACE ACTIVITIES. SUCH TCBMS CAN HELP INCREASE
TRANSPARENCY REGARDING GOVERNMENTAL SPACE POLICIES,
STRATEGIES AND POTENTIALLY HAZARDOUS ACTIVITIES -- THUS
REDUCING UNCERTAINTY OVER INTENTIONS AND DECREASING THE RISK
OF MISINTERPRETATION OR MISCALCULATION.

-- IN THIS REGARD, THE ADMINISTRATION WILL CONTINUE TO WORK
CLOSELY WITH OUR FRIENDS AND ALLIES IN EUROPE AND ELSEWHERE
TO DEVELOP VOLUNTARY TCBMS THAT ALL SPACEFARING NATIONS CAN
SUPPORT AND ACTIVELY PARTICIPATE IN FOR THE BENEFIT OF ALL
NATIONS.

-- ANY INTERNATIONAL EFFORT TO DEVELOP TCBMS SHOULD
COMPLEMENT, AND NOT UNNECESSARILY DUPLICATE, THE WORK OF THE
COPUOS.

-- IN SUPPORT OF THIS PRINCIPLE IN TODAY,S ENVIRONMENT, IT
IS IMPORTANT THAT THE UNITED STATES WORK CLOSELY WITH ITS
ALLIES TO IMPLEMENT THE DIPLOMATIC OR MILITARY MEASURES THAT
MAY BE NECESSARY BOTH TO ENSURE THE CONTINUED OPERATION (AND
RESPONSIBLE USE) OF MILITARY, INTELLIGENCE, CIVIL, AND
COMMERCIAL SATELLITES AND TO RESPOND APPROPRIATELY IF THESE
SATELLITES ARE TARGETED IN A HOSTILE MANNER.


21. MILITARY SPACE ACTIVITIES: THE NATURE AND CONDUCT OF U.S.
MILITARY SPACE ACTIVITIES WILL PROBABLY NOT BE A MAJOR ISSUE.
HOWEVER, SOME DELEGATIONS MAY RAISE VARIOUS U.S. MILITARY
ACTIVITIES AS A TACTICAL DEVICE TO UNDERCUT U.S. EFFORTS TO
PROMOTE GENERAL AND UNIVERSAL PRINCIPLES FOR SPACEFLIGHT
SAFETY. IF RAISED, USDEL MAY DRAW ON FOLLOWING POINTS, AS
NECESSARY:

-- LAWFUL MILITARY USES OF SPACE HAVE BROAD BENEFITS FOR THE
INTERNATIONAL COMMUNITY AND ENHANCE INTERNATIONAL PEACE AND
SECURITY. EXAMPLES INCLUDE TREATY COMPLIANCE/MONITORING,
COMMUNICATIONS, ENVIRONMENTAL MONITORING, GPS, REFUGEE
TRACKING, COUNTERTERRORISM, AND SANCTIONS ENFORCEMENT.

-- THE U.S. IS COMMITTED TO THE PRINCIPLE THAT ALL
SPACEFLIGHT OPERATIONS SHOULD BE CONDUCTED IN A SAFE AND
RESPONSIBLE MANNER THAT PROTECTS HUMANS IN SPACE AS WELL AS
ROBOTIC SPACE SYSTEMS AND THEIR MISSION EFFECTIVENESS.

ALSO WAS EXHIBITED IN LAST YEAR'S ENGAGEMENT OF THE DISABLED
USA-193 SATELLITE (REFTELS B AND C).

--- (IF ASKED) AS A U.S. EXPERT FORECAST IN A SPECIAL
TECHNICAL PRESENTATION MADE AT LAST YEAR'S STSC, DEBRIS
RESULTING THE SUCCESSFUL ENGAGEMENT OF USA-193 QUICKLY
RE-ENTERED THE EARTH'S ATMOSPHERE. THE LAST PIECE OF
TRACKABLE DEBRIS WAS ESTIMATED TO HAVE RE-ENTERED ON OR ABOUT
NOVEMER 16, 2008.
