1 (U) This cable corrects the date on which the diplomatic note was
received, please see paragraph 2.




2. (U) On December 15, CDA received the following diplomatic note,
dated December 1, from the Minister of Justice Dorothy Lightbourne
of the Ministry of Justice (MOJ):

Re: Request for extradition of Mark Clarke



I have the honour of addressing your Excellency on behalf of the
Government of Jamaica. I refer to the captioned matter. In
accordance with Article IX of the treaty I will require additional
information as set out hereunder before I can properly consider the
request as required by the provisions of the treaty and domestic
legal requirements.



(a) Whether the evidence which is contained in the
affidavit of James C. Nicholas was

presented to the Grand Jury which returned the indictment.



(b) If the answer to (a) is no then we are requesting a
copy of the evidence which was presented before the Grand Jury and
which formed the basis for the charge laid in the indictment.



(c) Whether any scientific analysis of the substance
alleged to be marijuana was done and whether the results of the
said analysis were placed before the Grand Jury.



(d) If the answer to (c) is yes we are requesting a copy
of the results of the said analysis.



We look forward to receiving the above mentioned information which
will enable me to expedite my deliberations so as to fully comply
with my obligations under the treaty and Jamaican law. Should you
have any queries in relation to the above please do not hesitate to
contact me.

3. (U) Post requests that Department coordinate response and notes
that these queries are similar to those outlined in the Government
of Jamaica (GOJ)'s response to the USG's Coke extradition request
(Ref A).
