1. (SBU) On September 9, Poloff spoke about the International
Court of Justice (ICJ) hearings on Kosovo with James Hennessy
and Marianne Bolger of the Western Europe and Western Balkans
Section of the Irish Department of Foreign Affairs (DFA).
Deputy Director Hennessy said that Ireland remains a stalwart
supporter of Kosovo and its independence, and that it stands
by Ireland,s brief to the ICJ to that effect on April 17.
He said Ireland had not participated in the second round of
briefs on July 17 because it did not have anything to add.


2. (C) Hennessy said Ireland had not yet decided whether to
participate in the December oral hearings before the ICJ, but
was leaning strongly against doing so for several reasons:
(1) Ireland had said what it had to say on April 17, nothing
had changed; and (2) preparing arguments for December would
be a &major undertaking8 for which neither the Western
Balkans Section nor the DFA Legal Department had much time.
Poloff replied that the December presentation need not be
long and could be based on the brief already presented on
April 17; the idea was for as many supporters of Kosovo
independence as possible to underline their position. Poloff
added that the U.S. legal team could coordinate with Ireland
if they so desired. Hennessy and Bolger said they would take
our points into consideration in upcoming DFA deliberations
on whether to present an oral statement in December.
