1. (C) Ambassador requested a meeting with Foreign Minister
Kadyrbek Sarbayev to press for a final resolution of the
issue resulting from the detention of two Embassy FSNs
(reftels). At the resultant meeting on December 10, Sarbayev
passed to the Ambassador a diplomatic note (translation
below) which states that our employees were wrongly detained
and that all legal proceedings against them have been
canceled.


2. (C) Post believes that this diplomatic note effectively
shields our employees from any further legal liability
resulting from this incident.


3. (SBU) Text of Diplomatic Note:

and has the honor to inform that employees of the U.S.
Embassy in the Kyrgyz Republic E. Chodronov and Z.
Abdykasymov were wrongly detained by the State National
Security Service of the Kyrgyz Republic in October 2009. In
view of the above, all legal proceedings regarding the above
mentioned employees of the Embassy have been canceled.
