1. (C) Summary. Germany supports the USG effort to include a
third subsidiary body at the NPT RevCon to address
Article X (treaty withdrawal) issues. However, it believes
the road ahead could be difficult due to NAM opposition.

2. (C) Post delivered reftel points on November 20 to MFA
Deputy Director for Nuclear Arms Control and Nonproliferation
Stefan Kordasch, who recognized that President-designate
Cabactulan was pushing for a RevCon similar to that held in
2000 -- with two subsidiary bodies. However, Kordasch said
that Germany saw no reason to break the trend of a third
subsidiary body on withdrawal introduced at the 2005 RevCon
and carried on in subsequent NPT PrepComs. In order to
avoid a bitter debate, he suggested characterizing our
proposal as a continuation of the current discussion model.
Kordasch expected the EU to adopt a similar position to that
of the U.S. and Germany.


3. (C) Nevertheless, Kordasch expected Article X discussions
to cause plenty of friction with NAM countries,
who would argue that withdrawal restrictions somehow place
additional burden on non-nuclear states -- an argument that
Germany rejects. He underscored that we must point to the
example of North Korea to emphasize our legitimate concerns
about countries reaping benefits from the NPT in order to
advance prohibited nuclear activities.
