(C) Isabel Rauscher, MFA Department Head for the Americas,
told Polchief October 30 that Austria could not accept the
Palestinian Guantanamo detainee mentioned in reftels.
Rauscher said the GOA would like to assist the USG in closing
the Guantanamo detention facility, but is unable to accept
inmates whose legal status is "unclear." If a detainee were
tried and either found guilty or acquitted, then the GOA
might be able to assist. But a detainee released without
trial would present legal problems for Austria, she said.
