1. This is an Action Request. See paragraphs 2-4.
2. The Department's Office of Defense Trade Controls
Compliance (PM/DTCC) requests Embassy's assistance in
conducting a post-shipment check on license 050064399 for the
export of J85 engine spare parts for the F5 aircraft to South
Korea. Embassy is requested to complete this Blue Lantern
check within 45 days. Lack of response to a Blue Lantern
check will affect pending and future licenses involving
parties to this license.
3. Reason for request: Kyongju Aerospace Electrical Systems,
unfamiliar foreign consignee.
4. ACTION: Embassy is requested to make inquiries with
appropriate host government officials to determine if the
Republic of Korea Air Force (ROKAF) has received the J85
engine parts and that the articles are being used for the
purpose stated on the license. Items shipped from the United
States to South Korea on December 27, 2007.
Department also requests that Embassy contact Kyongju in
order to provide an assessment of its business operations,
on-site security, and general reliability as a recipient of
United States Munitions List (USML) items. Kyongju POC is
Won-Seok, Lee, General Manager, TEL: 054-770-9600, reference
Purchase Order # KJP-07274 dated April 30, 2007. The
following questions are offered as suggested guidance with
Kyongju:
- Can Kyongju provide documentation (e.g. contract, purchase
order, or letter of intent) establishing the ROKAF as the end
user of the items in question?
- Who are Kyongju's main customers? Does it keep proper,
detailed records of its sales?
- Does the company understand the restrictions of USML
articles, particularly regarding re-exporting (no re-transfer
or re-export without USG authorization)? In post's
assessment, is the company a reliable recipient of USML
items?
