1. (C) As requested, on February 15, Polcouns conveyed reftel
demarche to Sergiy Kyslytsya, Director of the MFA's UN and
Other International Organizations Department, and urged
Ukraine not to support Serbia's plan to invoke the OSCE's
Berlin Mechanism immediately after an anticipated declaration
of independence from Kosovo. Kyslytsya said that he
understood the Serbians had already given up the effort to
invoke the Berlin Mechanism, citing a lack of support from
any other OSCE member except for Russia and four of the five
Central Asian states (with the exception of Turkmenistan).
Nevertheless, should the Serbs attempt to invoke the
mechanism, the Ukrainian delegation had firm orders to oppose
and not to join in the Serbian request. Kyslytsya noted that
the Berlin Mechanism had been developed prior to the creation
of the Permanent Council, and that it had not worked in the
only previous time it had been invoked in the early 1990's.
In Kyslytsya's view, the OSCE was already a "fragile"
organization and an attempt to use the Berlin Mechanism in
this case could cause serious damage.
