1. (U) This cable contains a short-fuse policy guidance
request, please see paragraph 4.
2. (C) The GoS expects to reach a decision this week on an
Export License Application submitted by AEY Inc. of Miami
Beach, Florida. Recent press reports have alleged the company
engages in untoward business practices, and the GoS has been
informed the company is under "suspension from future
contracting with any agency in the executive branch of the
United States Government," as per a letter from Robert N.
Kittel, Army Suspension and Debarment Official, dated March
25, 2008.
3. (C) The Slovak MFA asked if the USG will revoke or amend
the certification made in a letter dated February 8, 2008
from Daniel E. Stackick, Deputy for Security Assistance, U.S.
Army Joint Munitions Command, that the U.S. Army has placed
an order with AEY for 9,997,299 rounds of 7.62x39mm Tracer
and 2,302,999 7.62x54mm Tracer, and that as a United States
Foreign Military Sale, no import license is required. (The
letter referenced "Army Sustainment Command Contract
#W52P1J-07-D-0004, Task Order #0003.")
4. (C) Guidance Request. Request Washington's guidance
regarding the MFA's question about the validity of AEY's
contracts with the U.S. Army and how we should respond to GoS
concerning this application for an Export License. End
