1. (C) Embassy officers delivered reftel demarche on
Serbia's proposal to seek an advisory opinion from the
International Court of Justice regarding Kosovo to Ministry
of Foreign Affairs Security Affairs Department Chief Galib
Israfilov on September 5. Israfilov said the GOAJ's position
is "not yet defined" on the Serbian initiative. Baku's
position will be determined by the precise question(s) that
Serbia seeks to present in its UNGA resolution, observing
that Azerbaijan would like to be further consulted by Serbia.
2. (C) Israfilov reiterated the GOAJ's standing position
that Kosovo's independence violates international law and is
an example of "unilateral succession." Azerbaijan's approach
to the Serbian initiative will be tempered by policies
related to the Nagorno-Karabakh conflict, as well as
considerations related to the impact of Russia's recent
recognition of South Ossetia and Abkhazia.
