1. (SBU) According to the NDI Baku Acting Country Director,
on May 19, Ministry of Justice (MOJ) court bailiffs visited
the Election Monitoring Center's (EMC's) main office in Baku,
demanding that the EMC's secretary sign a statement that the
office was the EMC's official office. When she refused to do
so, the court bailiffs said they would return, and warned
that there would be consequences if the EMC did not comply.
They did not return. That same day, court bailiffs also
visited or contacted the EMC's staff in the regions of Ganja,
Khachmaz, Goychay, Jalilabad, and Sumgayit, demanding that
the staff sign self-written statements that they did not work
for the EMC. The EMC has stated that it will continue
working unless it is physically prevented from doing so.


2. (SBU) NDI Baku does not believe that any of the staff
signed statements. NDI Baku has instructed the EMC not to
sign statements and to tell the court bailiffs that requests
for action must be in writing, and that any action taken
should be transparent and in accordance with the law. NDI
Baku and the EMC report that the EMC's website has been
blocked since about an hour after court officials visited the
EMC's office on May 19. NDI Baku reported that the
coordinators of the EMC's offices in the regions of Imishli
and Mingechevir have resigned, citing media pressure as the
reason. The EMC also reported unspecified pressure on its
regional staff from local authorities. (NOTE: On May 14, a
Baku court ordered the deregistration and annulment of the
EMC. The EMC legally has ten working days from the date of
the verdict to appeal the court's decision to enforce the
verdict and one month to appeal the verdict.)


3. (C) COMMENT: The court officials' visits to the EMC's
offices seem to be the first attempt to enforce the court's
decision to revoke the EMC's registration and shut down the
EMC (ref a). It is unclear what the MOJ hoped to accomplish
by obtaining signed statements that these individuals do not
work for the EMC. It also is unclear on what legal grounds
the GOAJ may proceed to enforce the court order to close the
EMC. The EMC has committed to appealing the court ruling.
It is possible that collecting these signed statements is
part of the government's efforts to assemble more "evidence"
ahead of a prolonged legal fight.
