1. (S) Responding to the reftel demarche, MFA Acting Deputy
Director General for Nonproliferation and Disarmament Elif
Ulgen told us on July 22 that the Undersecretariat for
Foreign Trade (UFT) was recently approached by Tet Makina
reps regarding its application to export filament winding
machines to Pakistan. According to Ulgen, the company's
representatives told Turkish officials they were not aware of
the export restrictions concerning Pakistan. Ulgen said the
representatives claimed they had to go ahead with the
application knowing full well it would be rejected because
they would be financially liable for failure to fulfill the
contract if they decided on their own not to attempt to
deliver the machines. The company claimed that if the
machines could not be delivered because of a GOT decision not
to issue an export license, then it would no longer be bound
by the contract.


2. (S) Ulgen confirmed that Tet Makina's export license
application has been reviewed by an interagency panel and has
been rejected. As a result, Ulgen concluded, the company
will not be able to export the machines in question. She
said the GOT will continue to monitor the company, but there
are no plans to pursue any legal action against it at this
time.
