1. On June 28, 2007, U.S. Marshals will return Luis Virgilio
Saldana Perez to the United States to serve a sixty month
sentence following conviction in case number 2:01CR400-01.
first filed on June 14, 2001, in the U.S. District Court for
the District of New Jersey. As detailed in the Court's
judgment dated November 14, 2002, Saldana plead guilty on
August 9, 2002, to a single count of distributing and
possessing with intent to distribute more than 500 grams of
cocaine. The facts of the case demonstrated that on June 11,
2001, Saldana sold 1.3 kilograms of cocaine to a witness
cooperating with law enforcement authorities.
2. This case was brought before the Dominican government on
April 23, 2007, by virtue of an Embassy diplomatic note.
Shortly afterward, the Criminal Chamber of the Dominican
Supreme Court issued a provisional arrest warrant based on
the USG request for extradition.
3. Saldana was apprehended by Dominican authorities on June
19, 2007. A knowing, intelligent, and voluntary waiver of
his right to challenge extradition was executed before the
Criminal Chamber of the Dominican Supreme Court prior to his
return to the United States.
4. The return of Saldana marks the 21st Dominican-national
fugitive returned through or in lieu of extradition
proceedings during CY-2007 (the 12th for FY-2007).
