1. (U) Econoff delivered reftel points to Jose Rolando Monroy
Sintigo, Director of the Unidad de Investigacion Financiera,
Fiscalia General de la Republica (El Salvador's Financial
Intelligence Unit) on September 21.


2. (SBU) Monroy replied that his organization was eager to
fully implement the FATF's Special Recommendation IX on Cash
Couriers, but some changes had to be made to El Salvador's
existing law. First, El Salvador needed to lower its
declaration threshold from $11,400 to $10,000. Second, El
Salvador only requires cash declarations on entry, not on
departure. According to Monroy, this hinders their ability
to catch couriers from Guatemala who cross the land border
illegally and then fly from El Salvador to elsewhere in the
region.


3. (SBU) Monroy said that the Unidad de Investigacion
Financiera could not propose changes to the law itself and
needed a Minister or Deputy to introduce legislation or
amendments in the Legislative Assembly. According to press
reports, there is one proposal pending in the Assembly that
might address some of these concerns. Post will follow up
with the Government of El Salvador to urge that appropriate
provisions and amendments be adopted into law.
