WMD AMENDMENT

1. EmbOffs met with Stefano Nicoletti, Head of MFA's
Economic Affairs unit in their America's Office, regarding
the proposed WMD amendment to the Montreal Convention.
Nicoletti was not aware of the discussions on the proposed
amendment in the July ICAO Legal Sub-Committee meeting.
While he said that he would need to confer with GOI's
permanent representative to ICAO in Montreal on the subject,
Nicoletti stated that he believed that in principle there
would be no immediate opposition to the proposal since it
concerned security provisions.


2. EmbOffs subsequently met with Fabio Marchiandi, Head of
International Relations at ENAC (GOI's civil aviation
authority). Marchiandi informed us that GOI would have no
objection to the amendment from a security standpoint;
however, he articulated a concern about the potential for
such an amendment to affect insurance costs for air carriers,
and in turn passenger fares. In addition, he stated that the
safety aspects of the amendment required him to confer with
ENAC's safety representative. He also intends to discuss the
matter with ENAC's permanent representative to ICAO in
Montreal.


3. EmbOffs will follow-up with both Nicoletti and Marchiandi
the week of November 5-9 and report SEPTEL.
