1. (C) EMIN presented Reftel demarche September 3 to Geza von
Geyr, Director for U.S. and Canada in the German Federal
Chancellery. Von Geyr expressed appreciation for being
informed of USG concerns, and undertook to disseminate them
further within the German interagency community.


2. (C) EMIN and Global Affairs officer follwed up September
4 with German MFA Deputy Commissioner for Arms Control and
Disarmament Ruediger Luedeking and MFA Office Director of the
IAEA Unit Martin Langer. Luedeking agreed with EMIN that the
August 27 "Plan of Action" between the International Atomic
Energy Agency (IAEA) and Iran is inadequate. Luedeking said
that the "Plan of Action" leaves unfulfilled the demands of
UNSCR 1737 and 1747 for Iran to cease enriching uranium, for
the IAEA to verify the cessation thereof, and for Iran to
sign the Additional Protocol. Luedeking also said he shares
the U.S. concern over the sequencing provisions in the "Plan
of Action" and has questions about the Plan's modalities.
Iran clearly breached international law with its nuclear
programs and should have resolved the outstanding issue long
ago, according to Luedeking. He added that Iran has made
much of its right to develop nuclear power under Article 4 of
the Nuclear Nonproliferation Treaty (NPT) but has done
nothing to fulfill its corresponding obligations to permit
the IAEA to inspect its nuclear activities.


3. (C) Luedeking said that Iran must decide how it intends to
resolve international doubts about its nuclear program. On
the positive side, he said, Iran has at least acknowledged
with the "Plan of Action" that it has a duty to clarify the
outstanding issues with the IAEA. On the negative side,
Luedeking said he had doubts about Iran's earnestness. His
concern is that Iran is playing a tactical game with the IAEA
and trying to weaken unity among the EU3 of France, Germany,
and the UK. Luedeking stressed that the EU3 plus the
additional members of the Permanent UNSC must not allow their
unity to be disrupted by Iran. Luedeking also said the IAEA
should not take the Iranian "Plan of Action" at face value
but should press for full cooperation from Iran.


4. (C) In response to EMIN's question about a statement from
the EU3 at the September 10-14 IAEA Board of Governors
meeting in Vienna, Luedeking said that Germany would consult
with its two partners about a statement at a September 7
Political Directors meeting. Luedeking said the EU is
drafting a statement concerning nuclear nonproliferation but
has not finalized it yet. The EU strategy on
nonproliferation, Luedeking said, is to encourage the UNSC to
enforce nonproliferation universally.
