1. (S) Summary: Taiwan has issued an advance notice of an
amendment to its regulations that would partially meet
Taiwan's commitments under the August 2005 export control
"gameplan." End summary.
2. (S) Ministry of Economic Affairs (MOEA) Bureau of Foreign
Trade (BOFT) Export Control Task Force Head Wally Su called
AIT on May 3 to let us know that in a letter dated May 1 the
Minister of Economic Affairs had cleared an advance notice of
changes to Taiwan's export control regulations that will go
some way toward meeting Taiwan's commitments under the export
control gameplan agreed to in August 2005. The notice, which
has been posted on the BOFT website
(http://www.trade.gov.tw),allows seven days (from May 1) for
public comment on the proposed changes to the regulation
titled "Categories of Strategic High-Tech Commodities and
Restricted Areas." BOFT indicated the changes would become
effective shortly after the end of the comment period.
3. (SBU) The changes to the regulations are fairly simple:
The main change is adding the 89-item list (refs A and B,
referred to in the notice as the "sensitive commodity list
for exports to Iran and North Korea") to the categories of
goods requiring export, transit, and transshipment licenses.
It also clearly stated that all commodities in all Sensitive
High-Tech Commodity (SHTC) categories must have official
approval before transiting, transshipping, or being stored in
bonded warehouses. The 89 item list is available in both
English and Chinese on the BOFT website, but the notice
itself is currently only posted in Chinese.
4. (S) BOFT indicated that it was still seeking to expand
the 89 item list to include additional items that U.S.
agencies had designated as sensitive.
5. (S) Comment: While the 89 item list falls far short of
the number of items we wanted added to Taiwan's SHTC, it is a
step in the right director. It will be interesting to see to
what extent Taiwan is able to implement even this step given
the capacity limitations and technical issues reported ref C.
