1. (U) This is an action request - please see
paragraph 2.


2. (S) Action Request. Post should deliver
the note in paragraph 3 and draw from the
points in paragraph 4 to convey to the GOK
that the USG intends to include the three
detainees approved for transfer (refs B and
C) in the next Detainee Movement Operation
(DMO),which is scheduled for the December 10-
17 timeframe. Post should press the GOK to
provide a primary point of contact for
coordinating the logistics of the transfer,
and to begin such coordination as soon as
possible, in order to facilitate movement of
the detainees in December. Post should
clarify with the GOK whether it still intends
to submit a formal request for a visit to
Guantanamo on behalf of its security
officials (ref A). Post should press the GOK
to submit a formal request for such a visit
as soon as possible, and in accordance with
the guidelines in paragraph 4, so that DoD
can arrange a visit as soon as possible.
Finally, Post should provide the name,
classified email address, and telephone
numbers for Post's primary point of contact
for purposes of the detainee transfer.
Please note that, since coordination will
include the technical aspects of arranging a
milair flight, someone from Embassy's DAO
should be closely involved, if not designated
as the primary point of contact.


3. (S/REL to Kazakhstan) Begin Text of Note:

The Embassy of the United States presents its
compliments to the Ministry of Foreign
Affairs of the Government of Kazakhstan and
has the honor to refer to the Government of
Kazakhstan's note dated November 6, 2006,
regarding the return to Kazakhstan of persons
of Kazakhstani nationality who are currently
in the custody of the U.S. Department of
Defense at the U.S. Naval Base at Guantanamo
Bay, Cuba, and to inform the Government of
Kazakhstan of the following:

The Government of the United States is

prepared to transfer Haytugan Bakberganovich
Abahanov (ISN-526),Abdulluah Tohtasinovich
Magrupov (ISN-528),and Ilkham Turdbyavich
Batayev (ISN-084) to the exclusive custody
and control of the Government of Kazakhstan
as part of the next scheduled detainee
movement, which will be in December 2006. To
facilitate coordination of the transfer, the
Government of the United States requests that
the Government of Kazakhstan provide the U.S.
Embassy in Astana the name of the official
who will serve as the Government of
Kazakhstan's primary point of contact and
confirm that Astana International Airport is
a suitable location for the transfer.

The Embassy of the United States avails
itself of this opportunity to renew to the
Ministry of Foreign Affairs the assurances of
its highest consideration.

4. (S/REL to Kazakhstan) Begin Points:

-- The United States appreciates your
Government's continued cooperation in this
matter, and seeks to transfer the three
detainees from Guantanamo to Kazakhstan as
soon as possible.

-- We hope to include the detainees in the
next scheduled detainee movement operation,
which will be in the December 10-17
timeframe.

-- In order to facilitate movement of the
detainees in December, we ask that you
provide a primary point of contact for
coordinating the logistics of the transfer,
as soon as possible. Please also confirm
that Astana International Airport is a
suitable location for this transfer.

-- For the safety of the detainees being
transferred and U.S. personnel involved in
the detainee movement, it is imperative that
your Government use the utmost discretion in
discussing the dates and other details of the
detainee movement. Advanced public
disclosure of the dates and other specifics
of the movement could jeopardize the mission.

-- We understand that your Government's
security officials are interested in
traveling to Guantanamo.

-- The U.S. Department of Defense is prepared
to arrange such a visit.

-- To request the visit, your Government's
Embassy in Washington should submit a written
request to the Department of Defense through
the Department of State's Ambassador-at-Large
for War Crimes Issues, Clint Williamson.

-- The request should include the following:
the purpose of the visit (visits will be
approved only for purposes of obtaining
intelligence information or furthering
criminal investigations and prosecutions);
proposed timeframe; names, positions, and
passport numbers of all government officials
requesting to travel; detainees they wish to
see; languages to be used during the
interview; and any special requirements (such
as wheelchair access).
