1. (SBU) This is an action request. Per ref A request, the
Department of State and the Department of Homeland Security
(DHS) have reviewed the draft Note Verbale and three
Memoranda of Operation (MOO) for the Immigration Advisory
Program with the final minor change proposed by Japan,s
Ministry of Foreign Affairs (MOFA) to the MOO for the
Ministry of Justice. Embassy is requested to advise MOFA
that Washington agencies accept the text of the documents as
given in ref A, along with the final minor change to the MOO
for the Ministry of Justice, and are ready to move forward on
the exchange of notes to implement the program.


2. (SBU) DHS has identified the following officials who will
sign the three MOO for Customs and Border Protection: Jayson

P. Ahern, Assistant Commissioner, Office of Field Operations.
Agencies would appreciate confirmation of officials who will
sign for the National Police Agency, Ministry of Justice, and
Ministry of Land, Infrastructure and Transport.


3. (SBU) As proposed in ref B, Washington agencies agree
that the text of the embassy Note Verbale in reply to the
Japanese note should read as follows. Begin text:

The Embassy of the United States of America presents its
compliments to the Ministry of Foreign Affairs and has the
honor to refer to the note No. XXX from the Ministry of
Foreign Affairs of Japan.

The United States is confident that the high level of
cooperation and informational exchange that has been
established for such an important aspect of airline passenger
security will be beneficial to our two governments and shares
the understanding as set forth in the Japanese note.

The Embassy of the United States of America avails itself of
this opportunity to renew to the Ministry of Foreign Affairs
the assurances of its highest consideration.
