1. (SBU) We received a diplomatic note from the Ministry of
Foreign Affairs dated November 28 accepting the U.S. proposed
language for a new 505 agreement applicable to GPOI. The MFA
note acknowledged that the exchange constitutes an agreement
between the United States and Bosnia and Herzegovina. The
original diplomatic note and a certified copy of the original
note have been sent by registered pouch as requested per
reftel. The pouch registration number is 3941333.

The Ministry of Foreign Affairs of Bosnia and Herzegovina
presents its compliments to the Embassy of the United States
of America and acknowledges receipt of the Embassy's note No.
06-00-014, dated March 15, 2006, which reads as follows:

The Embassy of the United States of America presents its
compliments to the Ministry of Foreign Affairs of the
Government of Bosnia and Herzegovina and has the honor to
refer to earlier discussions between representatives of the
two governments regarding transfers of defense articles and
services from the Government of the United States of America
to the Government of Bosnia and Herzegovina. In this regard,
the Embassy refers to the Agreement related to the provision
of defense articles, related training or other defense
services from the United States to Bosnia, effected by
exchange of notes at Sarajevo on January 6 and 7, 1996.

In accordance with these discussions, it is proposed that the
Government of Bosnia and Herzegovina agree that the articles
and services provided by the Government of the United States
of America to the Government of Bosnia and Herzegovina
pursuant to the Global Peace Operations Initiative be subject
to the terms and conditions of the aforementioned agreement.

It is further proposed that the Government of Bosnia and
Herzegovina agree that the Government of the United States of
America may also, from time to time, make the provision of
articles, services, and related training furnished under
other authority (except the United States Arms Export Control
Act) subject to the terms and conditions of the
aforementioned agreement. (Transfers under the United States
Arms Export Control act shall continue to be governed by the
requirements of that Act and United States regulations
applicable to such transfers.)

The Ministry of Foreign Affairs' note stating that the
foregoing is acceptable to the Government of Bosnia and
Herzegovina shall, together with this note, constitute an
agreement between the two Governments, which shall enter into
force on the date of the Ministry's note.

The Embassy of the United States of America avails itself of
this opportunity to renew to the Ministry of Foreign Affairs
of Bosnia and Herzegovina the assurances of its highest
consideration.

The Ministry of Foreign Affairs of Bosnia and Herzegovina has
the honor to confirm that the proposals set forth in the
Embassy's note are acceptable to Bosnia and Herzegovina and
that the Embassy's note and this note in reply shall
constitute an Agreement between the two governments which
shall enter into force on this date.

The Ministry of Foreign Affairs of Bosnia and Herzegovina
avails itself of this opportunity to renew to the Embassy of
the United States of America the assurances of its highest
consideration.
