1. (U) Embassy contacted various GOU interlocutors to discuss
reftel demarche, including officials in the MFA's Office of
International Treaties and International Law, and a subject
material expert on MLATs at the Ministry of Education and
Culture. (Note: The GOU does not have a Ministry of Justice;
the Ministry of Education and Culture plays a significant
role in handling legal matters for the executive branch,
including extradition. End Note.)


2. (U) The MFA's Dra. Bertha Feder confirmed that the signed
Inter-American Convention on Mutual Assistance in Criminal
Matters (OAS MLAT) has not yet been submitted to the National
Congress for ratification, adding that the GOU still intends
to submit it. No date was offered for the submission and she
did not elaborate further. (Note: Uruguay has not signed the
Optional Protocol related to the OAS MLAT. End Note.)


3. (SBU) Separately, Doctor Eduardo Telechea (Central
Authority Counsel of International Cooperation at the
Ministry of Education and Culture) observed that the
bilateral MLAT between the US and Uruguay that entered into
force on April 15, 1994 seemed to be working well. He offered
to discuss MLAT issues in further detail at a mutually
convenient time. (Comment: Embassy will continue to press the
GOU to ratify the OAS MLAT. The expected resolution of the
high-profile extradition case of Juan Peirano Basso may
provide us with an opportunity to stress the tangible
benefits of mutual assistance in criminal matters with our
GOU counterparts. End Comment.)
