1. (SBU) On May 24 PolOff met with Ministry of Justice
(MOJ) Legal Advisor Pedro Nhatitima. In her meeting,
Nhatitima shared with PolOff the draft of a comprehensive
anti-terrorism law that includes sentencing penalties for
all offenses related to acts of terrorism, including
financing, supporting, colluding, or in any way being
associated with perpetrators of terrorism, including
individuals and/or organizations. Extradition and
extraterritorial acts of terrorism carried out by or
involving Mozambican nationals are also addressed by the
draft legal framework, as is the subject of kidnapping. Mr.
Nhatitima was not disposed to letting PolOff have a copy of
the draft at this time. However, he said this was
exclusively an MOJ initiative and after it is shared with
other key GRM officials, the international community
including the U.S. Embassy would be invited to provide
feedback.

2. (SBU) COMMENT: While this is an immensely important
development, as, to Post's knowledge, currently Mozambique
has no laws covering terrorism, there is no timetable for
the process of moving this proposed law forward. The
elaborate bureaucratic machinations required by Mozambican
law have, for past legal initiatives, taken several years.

3. (U) Poloff took the opportunity to deliver reftel talking
points regarding the addition of four Jemaah Islamiyah
leaders to the United Nations 1267 Sanctions Committee list.
Mr. Nhatitima said he would pass the information to the
Minister of Justice when she returned from European travels
next week, and would circulate the information to other
relevant counterparts in the government.

4. (SBU) Moving on to a finance theme, Mr. Nhatitima said
the draft proposal for the establishment of a financial
intelligence unit (FIU) has been finalized and will be
forwarded to the Council of Ministers for approval some time
before the conclusion of 2006. Once the Council officially
approves the formation of the FIU, the proposal to will be
forwarded to the Legislative Assembly for final
authorization. The interagency FIU will be headed by the
prime minister and will comprise representatives from
various ministries including Finance, Commerce, Justice,
Foreign Affairs as well as the Central Bank and Attorney
General's office. The proposal also envisions a "technical
unit" apart from the "political members," which will be
staffed by specialized bureaucrats representing various
government departments and agencies.
