1. (U) This is an action request, please see para 4.
2. (SBU) After almost two years, Post and the GOP have
partially resolved the issue of outstanding landing, parking
and other fees at the Lima Airport. Per Reftel, Post
delivered a diplomatic note to the Ministry of Foreign
Affairs on May 24, emphasizing U.S. policy that all state
flights should be exempt from fees at government airports.
Additionally, Post noted, that to the best of our knowledge,
all flights from February 11, 2001 through May 23, 2006 were
narcotics-related and thus exempt from fees per our 1984 and
1996 agreements with the GOP. We sent a copy of the
diplomatic note to WHA/AND and PM/ISO for their records.
3. (SBU) Augusto Arzubiaga, Director of Aviation Issues at
the Ministry of Foreign Affairs, contacted us on May 27 to
confirm receipt of the diplomatic note. He indicated that,
per our 1996 Narcotics Agreement, the Ministry of Transport
would pay the Lima Airport Partners (LAP) for fees on all
U.S. flights through May 23, 2006. Arzubiaga noted that the
issue is only partially resolved, as LAP will continue to
charge landing, parking and user fees for U.S. flights after
May 23. He informed us that the MFA is willing to negotiate
a Memorandum of Understanding with the USG to exempt all
state flights from paying fees, which will resolve the issue
in its entirety.
4. (SBU) In order to fully resolve this issue, Post
requests that the Department grant C-175 authority to
negotiate an MOU with the GOP on all state flights. We
appreciate the Department's continued assistance on this
issue.
