1. (SBU) We spoke to Martin Moscoso, head of Indecopi's
copyright office, on April 28 to discuss the listing of Peru
on the Special 301 Watch List, per reftel A. Moscoso stated
that while he understood why Peru included on the Watch
List, he wanted to emphasize that the GOP, working closely
with private industry, has taken steps to enhance public
awareness of IPR problems. He acknowledged that there must
be closer coordination between Indecopi and SUNAT, the
Peruvian tax and customs authority, particularly with
respect to raids, but noted that relations between the two
agencies had improved since October, when the Embassy and
U.S. Patent and Trade office hosted a training course for
Indecopi and SUNAT officials.
2. (SBU) Moscoso noted that Indecopi would be coordinating
closely with both the Ministry of Trade and the Ministry of
Health on the implementation of the U.S.-Peru Trade
Promotion Agreement (TPA) (ref B). Recognizing that
implementing the IPR chapter will be among the most
difficult, Moscoso reiterated his request for USG
assistance, particularly with regard to pharmaceutical data
protection and patent issues. He also indicated that the
GOP needs assistance in training law enforcement officials,
prosecutors and judges that handle IPR issues.
