1. (U) This is an action request. See paragraph 4.
2. (S/NF) Post has learned that Omar Rajab Amin and Abdullah
Kamel Al-Kandari, Kuwaiti nationals returned from detention
at Guantanamo Naval Base in September 2006, may be released
by the judge presiding over their investigation when their
current detention ends on December 24. The judge has
requested stronger evidence to justify continuing the
detention of Amin and Al-Kandari.
3. (S/NF) The judge said that to justify continuing the
detention, the evidence needed to be substantially stronger
than what the investigators had presented thus far. The
judge said more persuasive evidence might include:
- testimony about the circumstances of the original
apprehension;
- interview results;
- receipts of items seized;
- receipts of money seized;
- testimony of soldiers who apprehended the defendants.
4. (S/NF) Post requests that any further evidence available
for release to the GOK be made available as soon as possible.
