1. (SBU) On January 19, the Kurdistan Regional
Government-Erbil (KRG-E) Court of Cassation struck down the
lower court's December 19 conviction of Austrian citizen and
native Iraqi Kurd journalist and political activist Kamal Qadir
Karim, aka Kamal Sayid Qadir (KSQ). The lower court had
sentenced him to two consecutive 15-year sentences. The Court
of Cassation found the facts did not support a charge under the
statute (Article 1 of KRG Law 21 of 2003) for defaming public
institutions (in this case, the Erbil Governorate and the KRG-E
internal security organization, the Asayish). The Court of
Cassation returned the case to the investigative court for
investigation for criminal libel (Article 433 of Iraqi Law 111
of 1969).
2. (C) KRG-E Human Rights Minister Mohammed Ihsan Ahmed told
Regional Coordinator (RC) and Deputy RC January 30 that he
expected the new verdict very soon, with a sentence of three to
six months. Both Ahmed and KRG-E Interior Minister Karim
Sinjari said that KRG President Masoud Barzani would pardon KSQ
after the judicial process was complete. Ahmed thought the
pardon might render moot the other pending charges against KSQ.
Ahmed said KRG President Barzani could delegate the power to
pardon KSQ to his nephew, KRG Prime Minister Nechirvan Barzani.
KSQ remains in custody.
