1. (S) As requested, econoff delivered ref A points and the
text of the proposed Executive Order (E.O.) regarding
insurgency finance in Iraq on September 13 to Alle Dorhout,
who has the lead on EU designation issues in the Directorate
for European Integration within the Department of External
Policy at the Dutch Ministry of Foreign Affairs. Econoff
also delivered the points the same day to Margreet Wenting,
Senior Policy Advisor in the Department of Financial
Integrity at the Ministry of Finance, who said the MOF would
coordinate their response with the MFA.


2. (S) Dorhout responded on September 17 by thanking
econoff for the additional information on the proposed E.O.
and noting that the GONL remains interested in working with
the U.S. on any initiatives that could help to protect allied
forces in Iraq. Dorhout said the Dutch position, however,
had not changed since we first approached them about the E.O.
in July (see refs B and C). While noting the USG argument
that the measures proposed in refs A and D could address a
gap in current UN mechanisms by targeting individuals or
groups that fund attacks on troops in Iraq (and not civilians
and/or civilian targets),the MFA's legal department still
argues that actions against such individuals or groups could
be addressed under UNSCR 1267 or 1373. Without a universally
accepted definition of "terrorist," the MFA's legal
department argues that action could be taken against such
individuals or groups under existing UN mechanisms.
